PRIVACY

Privacy Policy

This policy explains how evoltLEDS may collect, use, share, and protect information when you interact with our website and services, including building and property information you choose to provide.

Status

This policy is published under documented privacy, technical, and legal holds. Its architecture is approved and the legal entity is confirmed, but the public language has not completed qualified legal review, and the production data-flow and Shopify app inventory has not been reconciled against observed runtime behavior. An always-on third-party affiliate tracking integration has been identified and not yet classified. Effective and review dates remain blank until those steps are complete. Sections describing systems that are not yet in production are withheld rather than stated as current practice.

Collect what we need. Explain why we need it. Protect it appropriately.

The privacy policy should describe the product that exists, not the product we intended to build.

1. Who We Are

This website and the services described on it are operated by evoltLED LLC, which trades as evoltLEDS. In this policy, “evoltLEDS,” “we,” “us,” and “our” refer to evoltLED LLC.

evoltLED LLC provides commercial lighting modernization and building performance services to commercial property owners, managers, and operators.

Our business phone, email, and mailing address appear in the Contact section at the end of this policy. A dedicated privacy contact address has not yet been established; until it is, privacy enquiries should use the business email shown there.

2. Information We Collect

Depending on how you interact with us, information may include your name, email address, phone number, company, professional information, property type, property location, approximate building size, number of properties, project timing, lighting information, your primary concern, preferred contact method, messages, scheduling information, documents, photographs, proposals, utility information, and other materials you intentionally provide.

Information may also be collected automatically, which may include IP address, browser, device, operating system, referring page, pages viewed, approximate location derived from IP address, timestamps, cookie identifiers, session information, and general usage information — but only to the extent actually collected by the systems running this website.

Information may also be received from service providers, referral or business partners, public business sources, and other services we intentionally use to interact with you.

3. Building and Property Information

Commercial property information may not always qualify as personal information under applicable law, but it can still be commercially sensitive. This may include utility bills, equipment information, property addresses, operating schedules, maintenance information, proposals, photographs, floor plans, project timing, capital priorities, and portfolio information.

We use such information for legitimate purposes related to the service you requested or the business relationship, and we restrict internal access based on business need.

Property information can still deserve careful handling.

4. Confidential and Commercially Sensitive Information

If you provide building documentation, utility information, proposals, photographs, operating schedules, maintenance information, portfolio information, plans, specifications, equipment information, pricing, capital-planning information, or other commercially sensitive materials, we may use that information for the purpose for which it was provided and for other legitimate purposes reasonably related to the relationship.

Submitting information through this website does not by itself create a nondisclosure agreement, a fiduciary relationship, or a separate confidentiality agreement unless we expressly agree to one in writing. Where a separate written confidentiality agreement applies, that agreement governs to the extent applicable.

5. Information About Other People

If you provide personal information about another person — including a colleague, owner representative, tenant representative, contractor, consultant, supplier, or other stakeholder — please provide it only when you are authorized or otherwise permitted to do so.

6. Professional and Business Contact Information

Many people interact with us in a professional capacity. Business contact information may still constitute personal information under applicable law, and we handle it accordingly where applicable.

B2B does not mean privacy-free.

7. Ownership and Use of Submitted Materials

You retain any ownership rights you may have in materials you provide. By submitting materials, you authorize evoltLEDS and appropriate service providers to access, process, copy, store, review, and use those materials as reasonably necessary to respond to your request, evaluate a potential project, provide agreed services, maintain related records, or support the applicable relationship.

Submission does not transfer ownership of the underlying materials to evoltLEDS.

8. Accuracy of Information Submitted

You are responsible for providing information that is accurate to the best of your knowledge. We may rely on customer-provided information for preliminary reviews, calculations, and communications, but such information may require validation before formal recommendations.

Customer Provided is an evidence source. It is not automatically Verified.

9. No Reliance on Website Submission Alone

Information submitted through a website form does not by itself constitute a completed building assessment, engineering review, project approval, eligibility determination, contract, warranty commitment, professional certification, or guaranteed result.

10. Sensitive Personal Information

Our general website forms are not designed to request Social Security numbers, driver-license numbers, complete payment-card data, banking credentials, passwords, medical information, biometric data, tax records, or other sensitive personal information. Please do not submit such information through a general website form.

If sensitive information is ever genuinely needed for a legitimate business purpose, we will request it through an appropriate secure process.

11. Utility Account Information

Utility bills may contain customer names, service addresses, account identifiers, usage, rates, and charges. Please provide only the information reasonably needed for the evaluation. Where practical, redact account identifiers you do not need us to see.

12. Building Security Information

Building information can reveal access points, security-lighting layouts, electrical rooms, tenant information, utility infrastructure, schedules, and other operationally sensitive details. We limit collection and internal distribution of such information to what is reasonably necessary, and we keep security-sensitive detail out of general notes where a more restricted record is appropriate.

13. Portfolio Information

Information about multiple properties, ownership structures, capital priorities, sequencing, operating conditions, or portfolio strategy may be commercially sensitive. Access is limited to personnel and service providers with a legitimate business need.

14. How We Use Information

We may use information to respond to inquiries, provide Building Performance Reviews, prepare for scheduled conversations, evaluate property opportunities, perform requested calculations or assessments, communicate about projects, provide resources, maintain appropriate business records, coordinate scheduling, operate and secure the website, troubleshoot, understand site usage, improve content and functionality, comply with law, prevent fraud or misuse, and protect rights and security.

Ask for more information only when the relationship has reached a point where more information is useful.

15. Sales and Follow-Up Communications

If you request information, submit a Building Performance Review, contact us, or schedule a conversation, we may use your contact information for reasonable follow-up related to that interaction.

Submitting a project form or scheduling a conversation does not automatically subscribe you to unrelated marketing communications.

Customer information provided for project execution is not automatically marketing permission.

16. Telephone Communications

Providing a phone number for an inquiry permits reasonable communications related to that inquiry or the business relationship, subject to applicable law. It does not automatically authorize unrelated automated marketing where separate consent is required.

17. Artificial Intelligence and Automated Tools

We may use technology-assisted tools to support organization, drafting, summarization, analysis of appropriate business information, or operational efficiency.

Before customer or property information is processed with such tools, we evaluate the nature of the information, the purpose, contractual protections, retention, model-training terms, and the appropriate level of human review. We do not make consequential customer or project decisions solely through automated decision-making without appropriate review.

AI convenience does not override the confidentiality expected around customer and building information.

The tool can assist the work. Accountability remains with evoltLEDS.

18. Lighting Savings Calculator

The calculator produces a result without requiring your name, email address, or phone number. The values you enter are used in your browser to produce the result.

Fixture counts, wattages, operating schedules, electricity rates, project costs, incentive amounts, calculated savings, and property details are not sent to analytics as event data.

Calculating and submitting are separate decisions. If you later choose to request validation, a Building Performance Review, or follow-up, the information you intentionally submit at that stage is transmitted to evoltLEDS.

A calculation does not need to become a lead automatically.

19. Analytics

Where analytics are used, they may record general activity such as page views, resource interactions, calculator starts and completions, form starts and completions, calls to action, and similar non-sensitive events.

Free-text property descriptions, detailed checklist responses, utility information, proposal content, and similar building information are not intentionally transmitted as analytics event parameters.

The complete inventory of analytics and similar technologies actually running in production is being verified against observed browser behavior. This section will state the specific technologies once that verification is complete.

Measure conversion without copying the submission into the measurement system.

20. Session Replay and Heatmaps

We do not deploy session-replay or heatmap technology on forms, calculator inputs, checklist answers, file-upload interfaces, or other sensitive workflows without privacy review and verified masking.

21. URLs and Error Logging

We do not intentionally place names, email addresses, phone numbers, property free text, or account information into URLs or query strings.

Error-reporting and logging are reviewed so that complete form submissions and sensitive property information are not unintentionally captured.

22. Cookies and Similar Technologies

This website uses cookies and similar technologies. Categories may include those strictly necessary for the site to function, functional or preference technologies, analytics and performance technologies, and advertising or targeting technologies.

We describe only the categories actually deployed. A separate Cookie Policy describing the specific technologies in use is being prepared and will be published once production behavior has been observed and verified in a browser. Where optional technologies require permission, rejecting them will not prevent you from reading our content or asking us to contact you.

Access to ordinary evoltLEDS content should not require acceptance of optional tracking.

23. Advertising and Retargeting

Before enabling advertising or retargeting technology, we determine what information would be transmitted, what consent or opt-out obligations apply, and whether the practice would qualify as sale, sharing, or targeted advertising under applicable law.

We do not allow an advertising vendor or agency to activate new data flows without privacy review.

24. Documents, Files, Photographs, and Video

Documents, photographs, proposals, utility information, and other files you intentionally submit may be used for the requested evaluation and related business purposes.

Submission does not automatically authorize public marketing use.

25. Case Studies, Testimonials, Logos, and Publicity

We do not publicly identify a customer, property, project, photograph, testimonial, project result, or customer logo as an evoltLEDS case study or endorsement solely because information was provided during an inquiry or project. Marketing use requires an appropriate separate basis or permission.

26. Aggregated and Deidentified Information

Subject to applicable law, we may create and use aggregated or deidentified information for methodology improvement, service analysis, market understanding, internal benchmarking, and business performance.

Aggregation is useful only when confidentiality survives the aggregation.

27. How We Share Information

Information may be disclosed to service providers and other parties as reasonably necessary to operate the business, provide requested services, maintain the website, communicate with you, comply with law, protect rights, or complete a legitimate business transaction.

Categories of potential recipients may include website hosting, records systems, scheduling, email delivery, analytics, IT and security providers, professional advisers, authorized project contractors or service partners, legal or government authorities where appropriate, and successors in a legitimate business transaction.

The specific service providers actually processing information are being inventoried and will be described here before this policy takes effect.

28. Service Providers and Vendor Security

Before deploying a third-party provider, we review its purpose, data access, security, retention, deletion, subprocessors, breach-notification terms, any AI or model-training terms, and termination procedures.

Every app or integration added to this website is reviewed for purpose, permissions, scripts, cookies, customer-data access, external processors, security, privacy impact, removal path, and ownership. We maintain an inventory of these integrations.

29. Selling, Sharing, and Targeted Advertising

Whether any of our practices constitute a sale, sharing, or targeted advertising under a particular statute depends on statutory definitions and on the technologies actually running in production. Both are under review.

Rather than make an absolute claim we have not verified, we will state our position in this section once that review and the accompanying legal review are complete.

Do not claim compliance with legal frameworks the business has not actually evaluated.

30. Security

We use administrative, technical, and organizational safeguards appropriate to the nature of the information and the business. Our internal practices address multi-factor authentication, least-privilege access, HTTPS, current software, backups where appropriate, vendor review, incident response, secure devices, periodic access review, and security training.

No method of transmission or storage can be guaranteed completely secure. We do not claim that our systems are impenetrable.

Access should follow job responsibility, not convenience.

31. Security Incident Response

We maintain processes designed to identify, evaluate, contain, and respond to suspected security incidents. Where notification is legally required, we provide notice as required.

32. Data Retention

We retain information only as long as reasonably necessary for the purposes described in this policy, including service delivery, business records, legal obligations, dispute resolution, agreements, and operational needs.

Specific retention periods for each category of information are being established as part of an internal retention schedule. We are not stating retention periods here until that schedule exists, because a published period we do not actually follow would be worse than none.

Deleted information may remain temporarily in backups or archives where immediate deletion is impractical. Records subject to litigation, investigation, audit, contract, or lawful preservation obligations may be retained beyond ordinary schedules.

Keep information for a reason, not forever by default.

33. Privacy Requests

Depending on applicable law, you may have rights such as access, correction, deletion, portability, or information about certain processing.

To make a request, contact us using the details at the end of this policy. We may need to verify your identity before acting on a request. Verification will be proportionate and we will not ask for more identifying information than the request requires.

Which privacy laws apply to evoltLEDS, and the resulting rights, appeal procedures, and authorized-agent processes, are under legal review. This section will state them specifically once that review is complete.

Do not create more identity risk while attempting to verify identity.

34. Fraud, Abuse, and Security Monitoring

Information may be used where reasonably necessary to detect, investigate, prevent, or address fraud, abuse, security threats, unauthorized access, violations of agreements, or harmful activity.

35. Legal Disclosures and Protection of Rights

Information may be disclosed where required or permitted by applicable law, subpoena, court order, governmental request, or legal process, or where reasonably necessary to establish, exercise, or defend rights, or to protect the rights, property, security, or safety of evoltLEDS, customers, users, personnel, service providers, or others.

36. Third-Party Websites and Integrations

Third-party sites and services are governed by their own privacy practices. Embedded or linked scheduling, maps, video conferencing, social media, or other tools may process information under their own terms in addition to acting as service providers where applicable.

37. Publicly Available Business Information

For legitimate business-to-business purposes, we may use appropriate publicly available business or property information.

We do not deploy lead-enrichment tools without privacy review, and we do not use them to import personal information we do not need.

38. Children's Privacy

This website and our services are intended for commercial and professional audiences and are not directed to children.

39. International Users

evoltLEDS serves commercial properties in the United States. We have not made a determination that international privacy frameworks apply to our operations, and we are not claiming compliance with frameworks we have not evaluated.

If we intentionally begin serving jurisdictions with additional requirements, we will update this policy after appropriate review.

40. Business Transfers

Subject to applicable law, information may be transferred as part of a merger, acquisition, financing, reorganization, sale of assets, insolvency, or similar legitimate business transaction.

41. This Policy Does Not Replace Contracts

This Privacy Policy describes information practices. It does not replace or modify separate contracts, confidentiality agreements, project agreements, or other written agreements between evoltLEDS and a customer or business partner. Where a separate written agreement governs particular information, that agreement may also apply.

42. Changes to This Policy

We may update this policy as the website, services, technology, or legal obligations change. When we do, we update the Last Updated date shown at the top of this page and provide additional notice of material changes where appropriate.

43. Contact Us

Privacy documentation should follow observed data behavior, not assumptions about data behavior. Where this policy does not yet name a specific vendor, retention period, or legal conclusion, that is because the fact has not been verified — not because it is being withheld.
