Terms of Use
These Terms govern use of the evoltLEDS website, its content, resources, calculators, and online features.
They govern website use only. Commercial lighting projects are governed by separate written project agreements.
Make the website useful without making it promise more than it can deliver.
Website Terms govern website use. Project agreements govern projects.
1. Acceptance and Scope
These Terms of Use govern your use of the evoltLEDS website, including its content, resources, calculators, forms, and other online features.
This website is operated by evoltLED LLC, trading as evoltLEDS. In these Terms, “evoltLEDS,” “we,” “us,” and “our” refer to evoltLED LLC. Contact information appears at the end of this document.
These Terms govern website use only. They do not govern commercial lighting projects. Where evoltLED LLC and a customer enter into a separate written project agreement, that agreement governs its subject matter.
2. Commercial and Professional Audience
This website is intended for commercial property owners, managers, operators, facility professionals, contractors, consultants, and other business audiences. It is not directed to consumers or children.
3. Informational Nature of Website Content
Website content is general and informational. It is intended to help you understand how lighting modernization and building performance work may be evaluated. It is not a building-specific recommendation.
Website information can inform a decision. It does not replace the project-specific work required to make the decision.
4. Website Interaction Does Not Create a Contract
Using this website, submitting a form, scheduling a conversation, requesting a Building Performance Review, using the calculator, or making an inquiry does not by itself create a customer contract, professional engagement, fiduciary relationship, partnership, joint venture, agency relationship, exclusivity, or an obligation for evoltLEDS to issue a proposal.
A conversation can begin online. A project begins when the appropriate agreement says it begins.
5. Authority to Submit Information
A person who provides building information through this website is not automatically deemed authorized to approve work, incur costs, or bind a property owner or organization.
You should have appropriate authority to submit files, photographs, plans, proposals, personal information, and other materials, and your submission should not violate any third party's intellectual property, confidentiality, privacy, or contractual rights.
6. No Reservation of Resources
No website interaction reserves equipment, inventory, labor, installation capacity, pricing, project dates, incentive funds, or any other resource unless expressly confirmed in an applicable written agreement.
7. Building Performance Review and Assessment Scope
A Building Performance Review or commercial lighting assessment has a defined scope. Site observation is limited to what is reasonably accessible and observable at the time. Inaccessible, concealed, energized, occupied, or obstructed conditions may not be evaluated.
Findings rely in part on information available at the time, which may be incomplete.
A review identifies what deserves further attention. It does not predetermine the answer.
8. Evidence Standard
Where the source and certainty of information is material to a decision, evoltLEDS distinguishes between information that is Observed, Customer Provided, Documented, Assumed, Estimated, and Verified.
Customer-provided and third-party information may be relied upon but is not automatically independently verified. Existing drawings, fixture schedules, panel schedules, plans, inventories, and documentation may not reflect current field conditions.
Customer Provided is a source. It is not automatically Verified.
9. Conditions Can Change
Building and operating information can change. Occupancy, schedules, equipment condition, tenancy, and use may differ from the conditions on which an analysis was based, and may require reevaluation.
10. Lighting Savings Calculator
The calculator is a preliminary screening tool. It is not a bid, proposal, guarantee, investment recommendation, or a guaranteed measure of future performance.
Results depend entirely on the values entered. Incorrect inputs produce incorrect results. Software errors, interruptions, browser behavior, and technical limitations may affect availability or output.
The published calculation methodology, its assumptions, and its exclusions are set out in the Lighting Savings Calculator Disclaimer, which forms part of these Terms in respect of calculator use.
A calculator validates arithmetic. An assessment validates assumptions.
11. Financial Information Boundaries
Simple payback is one screening metric. It is not a complete financial analysis, and it is not labeled as return on investment.
Unless expressly included, calculations and website content exclude demand savings, maintenance savings, controls savings, HVAC interactions, carbon impacts, financing effects, escalation, time value of money, taxes, tax incentives, property valuation, net operating income or cap-rate impact, and other benefits or costs.
The label should follow the calculation.
12. Savings Attribution
Changes in whole-building utility bills may be affected by occupancy, weather, utility rates, operating schedules, tenant changes, other electrical loads, and other factors unrelated to a lighting change.
A modeled lighting-energy reduction is not the same as a measured whole-building bill reduction unless formal measurement and verification is expressly scoped.
13. Incentives and Rebates
evoltLEDS makes no guarantee of incentive eligibility, approval, reservation, amount, funding, continued availability, timing, or payment.
Utilities, agencies, and program administrators control their own programs, requirements, and funding. evoltLEDS cannot bind them.
Potential Is Not Approved.
14. Products, Manufacturers, and Warranties
References to products or manufacturers do not imply sponsorship, endorsement, certification, authorization, partnership, agency, or affiliation unless expressly verified.
Manufacturer specifications, rated life, warranties, availability, lead times, performance data, and certifications may change, as may third-party software and services.
Manufacturer warranties are separate from any warranty expressly provided by evoltLEDS. Coordinating a manufacturer warranty claim does not make evoltLEDS the warrantor of third-party equipment. Product substitutions and availability changes follow the applicable project process.
15. Codes, Approvals, and Jurisdiction
Codes, standards, regulations, utility requirements, permitting, inspections, landlord approvals, architectural approvals, tenant coordination, and other approvals depend on the actual project and jurisdiction.
16. Some Decisions Require Another Discipline
Website content is not regulated engineering, architecture, legal, tax, accounting, investment, electrical-safety, life-safety, environmental, or other professional advice unless expressly scoped and lawfully provided.
Website channels are not emergency-response services. If you have an emergency, contact the appropriate emergency service.
Some decisions require another discipline.
17. Hazardous and Concealed Conditions
Hazardous or concealed conditions, including asbestos, lead, mold, PCBs, environmental contamination, structural deficiencies, concealed electrical defects, and similar conditions, are outside ordinary website review. They must be handled according to the actual project scope by appropriately qualified parties.
18. Existing Building Systems
Existing electrical, control, structural, network, building-management, emergency, and other systems may affect feasibility or performance. Their condition and compatibility are not warranted unless expressly scoped.
Connected controls, gateways, networks, cloud services, applications, cybersecurity, interoperability, software support, and continued third-party service availability are subject to project scope and third-party dependencies.
19. Site Access and Schedule
Site access, escorts, restricted areas, keys, tenant coordination, parking, loading, work hours, shutdown approvals, lifts, and security procedures may affect project feasibility and scheduling.
Customer, utility, supplier, manufacturer, contractor, permitting, access, and other delays may affect schedules. Dates referenced on this website are not guaranteed completion dates.
Commercial work may involve temporary operational effects. Language about minimizing disruption is not a guarantee of zero disruption.
20. Materially Different Field Conditions
Materially different field conditions may require revised recommendations, equipment, scope, price, schedule, or change procedures under the applicable agreement.
21. Analyses Are Building-Specific
Analyses and conclusions are specific to the building and purpose for which they were prepared. They should not be relied upon by unidentified third parties, and they should not be transferred to another building.
Portfolio conclusions should not be extrapolated without appropriate analysis.
No conclusion concerning one building should be assumed to apply to another building merely because the properties appear similar.
Repeat the framework. Recalculate the opportunity.
22. Service Descriptions and Service Area
Service-area descriptions do not guarantee project acceptance in any geography. Service descriptions identify general capabilities; actual obligations are determined by the applicable signed scope.
Service descriptions explain what evoltLEDS may be able to do. The signed scope determines what evoltLEDS has agreed to do.
23. Illustrations, Examples, and Imagery
Website marketing language, illustrations, frameworks, examples, photographs, renderings, diagrams, mockups, and educational content are general unless expressly incorporated into a project agreement.
Illustrative examples are not actual project results unless expressly identified as such. Conceptual, digitally created, AI-generated, or modified imagery is not documentation of a completed evoltLEDS project unless expressly identified as such.
Screen images cannot guarantee real-world brightness, correlated color temperature, color rendering, color appearance, glare, uniformity, or photometric performance.
Examples can illustrate the method. Only real projects should prove the result.
24. Case Studies and Testimonials
Where case studies are published, they describe specific circumstances and do not guarantee equivalent results elsewhere. Where testimonials are used, they are real and authorized, and are not guarantees of results.
25. Emerging Technologies
Educational discussion of energy storage, distributed energy resources, resilience, microgrids, solar, EV infrastructure, grid-interactive buildings, or other technologies does not mean evoltLEDS currently provides those services.
Understanding an emerging capability is not the same as claiming we currently deliver it.
26. No Financing, Tax, or Accounting Commitment
References to financing or third-party funding do not constitute an offer of credit, a financing approval, or a commitment.
Tax, accounting, depreciation, capitalization, deduction, credit, and similar treatment are not provided as tax or accounting advice.
27. Insurance, Licensing, and Certification
Any statement about insurance, licensing, certification, authorization, or qualification applies only as expressly stated, and only where current and applicable to the work in question. Nothing on this website should be read as an implied insurance, licensing, or certification claim.
28. Project Agreements Control Actual Work
Signed project documents govern their subject matter, including scope, exclusions, price, schedule, payment, access, changes, site conditions, installation, warranties, insurance, and dispute procedures.
Quotes and proposals define their own validity, scope, pricing, exclusions, assumptions, taxes, payment, availability, schedule assumptions, change procedures, warranties, and acceptance as applicable.
Nothing in these website Terms is intended to override a negotiated project agreement.
Do not ask a website disclaimer to do the job of a project contract.
29. Intellectual Property
Website content, including text, layout, frameworks, graphics, and downloadable resources, is owned by evoltLEDS or its licensors. Third-party trademarks remain with their respective owners.
You may use website content and expressly downloadable resources for legitimate internal business use.
You may not resell, rebrand, republish, or frame website content, imply a misleading affiliation, conduct large-scale scraping or malicious automated access, circumvent access controls, reverse engineer where legally prohibited, or conduct unauthorized security testing.
30. Your Submissions
Materials you submit remain owned by their owner. evoltLEDS receives the rights reasonably necessary to process them for the requested relationship and legitimate related purposes, as described in the Privacy Policy.
Malicious, unlawful, harmful, or suspicious files and submissions may be rejected, quarantined, deleted, or declined.
General feedback about the website or our materials may be used to improve evoltLEDS. This does not convert customer project information into unrestricted feedback.
31. Prohibited Uses
You may not use this website for unlawful conduct, fraud, impersonation, distribution of malicious software, unauthorized access, vulnerability probing without authorization, interference with website operation, data harvesting, spam, abuse, infringement, circumvention of technical measures, or false claims of affiliation.
32. Third-Party Links and Embedded Services
Third-party links and embedded services have their own terms, availability, security, privacy practices, and content. A link does not necessarily indicate endorsement.
33. Website Availability and Accuracy
Website features and content may be modified, suspended, restricted, replaced, or discontinued.
Website content is not guaranteed to be complete, current, error-free, uninterrupted, or suitable for every building or purpose. Archived information may reflect prior programs, technologies, prices, regulations, or offerings.
We correct errors as we become aware of them and update content editorially as appropriate.
34. No Guarantee of Business Results
evoltLEDS does not guarantee energy savings, operating-cost reduction, property value, capital approval, incentive receipt, maintenance reduction, tenant outcomes, equipment life, uptime, or any other specific business result, unless expressly guaranteed in a signed project agreement.
A website should never create a broader obligation than the project evoltLEDS actually agreed to perform.
35. Electronic Communications
Communicating with evoltLEDS electronically does not constitute consent to unrelated marketing communications.
Electronic signatures apply only through a designated acceptance mechanism, not through ordinary website browsing or correspondence.
36. Restriction of Website Access
evoltLEDS may restrict or terminate website access in response to abuse, security threats, unlawful activity, violations of these Terms, or legitimate technical or business reasons.
37. Changes to These Terms
These Terms may be updated as the website, services, or legal obligations change. The Last Updated date shown at the top of this page reflects the current version, and prior versions are retained internally.
Updating these website Terms does not rewrite a separately executed project agreement unless that agreement expressly provides otherwise.
